Taraflar\u0131n r\u0131zas\u0131 ile akdedilen bu s\u00f6zle\u015fme belirli \u015fartlar\u0131n kar\u015f\u0131lanmas\u0131 halinde bildirim veya dava yolu ile sona ermektedir.&nbsp; S\u00f6zle\u015fmenin sona ermesi T\u00fcrk Bor\u00e7lar Kanunu ile h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\">\n<li><strong>Bildirim Yolu \u0130le<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong style=\"background-color: var(--nv-site-bg); color: var(--nv-text-color); font-family: var(--bodyfontfamily); font-size: var(--bodyfontsize); letter-spacing: var(--bodyletterspacing); text-transform: var(--bodytexttransform);\">S\u00fcreli kira s\u00f6zle\u015fmelerinde<\/strong><span style=\"background-color: var(--nv-site-bg); color: var(--nv-text-color); font-family: var(--bodyfontfamily); font-size: var(--bodyfontsize); font-weight: var(--bodyfontweight); letter-spacing: var(--bodyletterspacing); text-transform: var(--bodytexttransform);\"> kirac\u0131, s\u00f6zle\u015fme s\u00fcresinin bitimine 15 g\u00fcn kal\u0131ncaya kadar bildirimde bulunmak zorundad\u0131r. Aksi halde s\u00f6zle\u015fme bir y\u0131l daha uzam\u0131\u015f say\u0131lacakt\u0131r. Bu h\u00fck\u00fcm kirac\u0131y\u0131 korumak maksad\u0131 i\u00e7ermektedir. Ayr\u0131ca belirtmek gerekir ki bu bildirimin ge\u00e7erlili\u011fi yaz\u0131l\u0131 \u015fekilde yap\u0131lmas\u0131na ba\u011fl\u0131d\u0131r.&nbsp; Kiraya verenin ayn\u0131 \u015fekilde bir hakk\u0131 bulunmamaktad\u0131r. Kiraya veren yaln\u0131zca on y\u0131ll\u0131k uzatma s\u00fcresinin sonunda ve bu s\u00fcreyi izleyen her s\u00f6zle\u015fme s\u00fcresinin bitimine 3 ay kal\u0131ncaya kadar bildirimde bulunarak, herhangi bir sebep g\u00f6stermeden s\u00f6zle\u015fmeyi sona erdirebilir.<\/span><\/li>\n\n\n\n<li><strong>Belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde <\/strong>kirac\u0131, her zaman fesih bildiriminde bulunarak s\u00f6zle\u015fmeyi sona erdirebilir. Kiraya veren ise s\u00fcreli kira s\u00f6zle\u015fmeleri ile ayn\u0131 \u015fekilde on y\u0131ll\u0131k uzatma s\u00fcresinin sonunda 3 ayl\u0131k fesih bildirim s\u00fcresine uyarak s\u00f6zle\u015fmeyi feshedebilecektir.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Dava Yolu \u0130le&nbsp;<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Tahliye davalar\u0131nda g\u00f6revli yarg\u0131 yeri Hukuk Muhakemeleri Kanununa g\u00f6re sulh hukuk mahkemesidir.<\/p>\n\n\n\n<ul class=\"wp-block-list\" type=\"a\">\n<li><strong>Kiraya verenden kaynakl\u0131 sebepler :Kiraya verenin kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekli ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imk\u00e2ns\u0131z ise,<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>belirli s\u00fcreli s\u00f6zle\u015fmelerde<\/strong> s\u00fcrenin sonunda, <strong>belirsiz s\u00fcreli s\u00f6zle\u015fmelerde<\/strong> kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.<\/p>\n\n\n\n<ul class=\"wp-block-list\" type=\"i\">\n<li><strong>Yeni malikin <\/strong>ta\u015f\u0131nmaz\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut veya i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, edinme tarihinden ba\u015flayarak bir ay i\u00e7inde durumu kirac\u0131ya yaz\u0131l\u0131 olarak bildirmek ko\u015fuluyla, kira s\u00f6zle\u015fmesini alt\u0131 ay sonra a\u00e7aca\u011f\u0131 bir davayla sona erdirebilir. Kiralanan\u0131 sonradan edinen ki\u015fi, dilerse gereksinim sebebiyle s\u00f6zle\u015fmeyi sona erdirme hakk\u0131n\u0131, s\u00f6zle\u015fme s\u00fcresinin bitiminden ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava yoluyla da kullanabilir.<strong><\/strong><\/li>\n<\/ul>\n\n\n\n<p>Kiraya veren, gereksinim amac\u0131yla kiralanan\u0131n bo\u015falt\u0131lmas\u0131n\u0131 sa\u011flad\u0131\u011f\u0131nda, hakl\u0131 sebep olmaks\u0131z\u0131n, kiralanan\u0131 <strong>\u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e eski kirac\u0131s\u0131ndan ba\u015fkas\u0131na kiralayamaz.<\/strong> Yeniden in\u015fa ve imar amac\u0131yla bo\u015falt\u0131lmas\u0131 sa\u011flanan ta\u015f\u0131nmazlar, eski h\u00e2li ile, hakl\u0131 sebep olmaks\u0131z\u0131n <strong>\u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e ba\u015fkas\u0131na kiralanamaz.<\/strong><strong><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Kirac\u0131dan kaynaklanan sebepler: Kirac\u0131, kiralanan\u0131n teslim edilmesinden sonra, kiraya verene kar\u015f\u0131, kiralanan\u0131 belli bir tarihte bo\u015faltmay\u0131 yaz\u0131l\u0131 olarak \u00fcstlendi\u011fi h\u00e2lde bo\u015faltmam\u0131\u015fsa kiraya veren, kira s\u00f6zle\u015fmesini bu tarihten ba\u015flayarak bir ay i\u00e7inde icraya ba\u015fvurmak veya dava a\u00e7mak suretiyle sona erdirebilir. Bo\u015faltma taahh\u00fcd\u00fc yaz\u0131l\u0131 olmak zorundad\u0131r.
